Liability Protection Guidance

The Liability Protection Guidance Specification is an open source, modular specification designed to help software systems identify potential liability risks and provide structured guidance for reducing exposure. It focuses on practical risk awareness rather than attempting to replace qualified legal counsel. The specification provides a consistent framework for analyzing circumstances, separating facts from assumptions, identifying potential civil and criminal liability concerns, and determining when additional review or escalation may be appropriate.

A major feature of the specification is its emphasis on evidence preservation and documentation. Core modules provide guidance for preserving potentially relevant documents, communications, photographs, video, digital records, physical evidence, and other materials. Documentation features encourage chronological, factual records while distinguishing direct observations from statements, assumptions, and conclusions. Witness identification and recordkeeping capabilities further help users establish who may have relevant firsthand knowledge and maintain important records over time.

The specification also includes risk mitigation and safety-focused guidance. Systems can identify foreseeable risks, prioritize them according to severity and urgency, and recommend preventative or corrective actions. Safety concerns can take priority when immediate harm is possible, ensuring that administrative liability processes do not interfere with urgent protective actions.

Its modular architecture allows the core specification to be extended through optional plugin modules. Plugins can provide specialized functionality for incident response, employment liability, business operations, property and premises, digital evidence, cybersecurity, healthcare and caregiving, transportation, legal holds, jurisdiction-specific requirements, auditing and compliance, and AI-assisted decision support. This allows implementations to remain focused while adding specialized capabilities as needed.

The specification is particularly suited for AI-assisted decision-support systems because it establishes clear distinctions between facts, assumptions, risks, recommendations, evidence, and sources. Human review and escalation can be incorporated for high-consequence situations, while source provenance and uncertainty handling help prevent generated guidance from being presented as established legal fact.

This specification is released under the AGPL-3.0+ license and is free to use with required attribution. Attribution-free deployments may obtain a Specification Branding License, with fees based on usage, deployment scope, and environment size.
